1. SERVICE DESCRIPTION. DEFINITIONS

The website www.myaurasound.com, hereinafter referred to as "aurasound" or the "Website," is used by CyberDigital PTE. LTD., with its registered office in Singapore, hereinafter referred to as the Website Owner/the Seller. Through the Website, the Owner, in its capacity as the seller, shall ensure the sale of goods and/or services to Customers.

The below terms shall be defined as follows:

  • User - any natural person accessing the Website to consult the commercial offer, whether or not they place an Order.

  • Registered User - a person who accesses the Website using an account based on a user agreement with aurasound.

  • Customer - any person who accesses the Website and places an Order.

  • Buyer - The Customer who has entered into a Contract with the Website Owner.

  • Account - the Website section consisting of an e-mail address and a password, which allows the Buyer to submit an Order.

  • Order - the electronic request whereby the Buyer expresses their intention to purchase goods and services from the aurasound offer.

  • Order Confirmation - an automated email received by the Customer detailing the Order. This confirmation legally marks the moment the Contract is entered into.

  • Contract - The Order confirmed electronically by the Seller to the Buyer.

  • Content - all information published on the Website.

  • Newsletter - periodic electronic information regarding products, services, and/or promotions.

  • Transaction - receipt or reimbursement of an amount from the sale of a product/service.

The Website Owner reserves the right to restrict or exclude a User's access or delete an Account if their conduct prejudices aurasound or its Customers. Any such action will comply with these terms.

2. THE USER'S REGISTRATION

To place an Order, the User may register on the Website. You commit to providing real, accurate, and complete data in the registration form. The Website Owner reserves the right to check the authenticity of the registration data. By accepting these Terms, the User consents to any potential checks. If information is found to be inaccurate, the Website Owner may suspend the User's access. The User is solely responsible for the information provided.

3. ORDER REGISTRATION, CONFIRMATION, AND PROCESSING

Products can only be sold based on an Order. An unconfirmed Order does not reserve the products. Orders are processed chronologically. By placing an Order, the Buyer agrees to electronic communication.

The stages of an Order are:

  1. Order registration, generating a unique code.

  2. Order take-over by a salesperson.

  3. Order Confirmation after checking stock, provided by a salesperson via telephone or email.

  4. Delivery after confirmation and agreement on delivery details.

The Seller may cancel an Order for reasons including non-acceptance of the transaction by the bank, invalidation by the card processor, incomplete or inaccurate data provided by the customer, customer activity that causes damages, or more than two failed delivery attempts.

Natural person Customers may withdraw from a Contract within 14 days of receiving the products, in accordance with applicable consumer protection laws in Singapore. Caution: For products customized at the Customer's request, the Customer has no right to return or withdraw from the Contract. Any advance payment made for a customized order will not be reimbursed if the order is cancelled.

4. PRICE, INVOICING, AND PAYMENT OF THE PRODUCTS

Product prices are displayed on the Website and include applicable taxes (e.g., VAT or GST) for relevant jurisdictions, in accordance with local laws. If prices are displayed erroneously, the Seller has the right to cancel unconfirmed orders. The reference currency for payment and invoicing will be stated on the Website (e.g., USD, SGD, JPY).

The price, payment method, and terms are stated in each Order. The Seller will issue an invoice for the delivered goods, and the Buyer must provide all necessary information. The invoice will be sent electronically to the Buyer's email address. aurasound is not liable for any additional costs incurred by the Customer, such as foreign exchange fees applied by their card-issuing bank. Responsibility for such fees belongs to the Customer.

5. DELIVERY OF THE PRODUCTS

Products are delivered via a fast courier company. Deliveries are typically made within [e.g., 3-10] business days from Order Confirmation for in-stock items. Delays may occur due to stockouts or external factors. For pre-orders or special requirements, the delivery term may be up to 30 business days. Upon receipt, it is recommended to check the products for any physical defects from transport.

6. PRODUCT WARRANTY

All products sold by aurasound have warranty conditions in accordance with the applicable laws of Singapore and Japan, and the commercial conditions of the manufacturers. All products are new and in their original packaging. Any repairs or replacements will be carried out within a reasonable period, not to exceed 15 calendar days. The rights specific to natural person consumers are not granted to legal person Buyers.

7. PRODUCT RETURNS

Natural person consumers have the right to withdraw from the Contract and return a Good within 14 calendar days without claiming reasons, other than covering delivery costs. The return period expires 14 days from the date the Buyer takes physical possession of the Good. To withdraw, the consumer must inform the Seller via email. If an Order is paid, the Seller will reimburse the amount within 14 days from being informed of the withdrawal. The Seller may postpone reimbursement until the returned product is received and assessed.

Exemptions from the right of withdrawal include:

  • The supply of goods manufactured or clearly customized to the Buyer's specifications.

  • Consumable products that have been unsealed.

Products must be returned in their original packaging with all accessories, labels, and documents intact. Any damage to the product or packaging that prevents its sale as new will lead to a reduction in the value of the refund, between 10-90% of the initial value.

8. INTELLECTUAL PROPERTY

The User acknowledges that all graphical creation and Website Content are the property of aurasound. The User commits not to reproduce, copy, sell, or use the services or information from the Website, in whole or in part, without prior written consent. The wooden products presented may have a different design from the images published on the Website, as the structure of the wooden material can vary between products.

9. DISPUTES

Any disputes between the User and aurasound shall be settled amicably. If amicable settlement is not possible, the conflict shall be settled by the competent court in Singapore.

10. GOVERNING LAW

By accessing the Website, the User accepts that this Contract and any related dispute are governed and construed in accordance with the laws of Singapore. The User agrees to be subject to the exclusive jurisdiction of the competent Singaporean courts. If a User accesses the Website from outside Singapore, they do so at their own risk and are responsible for compliance with the laws of the country where they are.
